Operating a Pesticides Store
In order to operate a Pesticides Store in the Republic of Cyprus, one needs to obtain a licence for a Pesticide Store, by the Plant Protection Products and Biocides Board, that operates within the Department of Agriculture of the Ministry of Agriculture, Rural Development and Environment.
The term “pesticides” refers to any preparation, used as a means of direct or indirect prevention, reduction, or control of diseases and pests, and includes insecticides, nematicides, fungicides, bactericides, herbicides, rodenticides , snailcides, plant regulatory agents, desiccants, defoliants, attractants, sterilizers, fumigants, additives and other preparations will be defined as a pesticide by the Council, whether they can be used for agricultural, residential or environmental protection.
The term “pesticides store” refers to a “shop” means premises where there is retail sale of pesticides directly to farmers and where there may be a small store attached or adjacent to the store for maintaining a quantity of pesticides.
Who is Eligible
Both natural persons and legal entities are eligible to apply and obtain the license for a Pesticides Store. Every natural persons or legal entity is eligible to obtain the license for a Pesticides Store, provided that the Plant Protection Products and Biocides Board is satisfied that the following criteria are met:
- the store is constructed with appropriate materials to ensure that pesticides are protected from weather conditions (light, sun, rain, wind) and in general to assure their physical condition as well as their stated life period;
- the floor is watertight, without cracks, made of materials which do not absorb pesticides that may leak, and is easily cleaned;
- the store has the proper size and is arranged in such a way that the pesticides are classified into categories (e.g. Insecticides, fungicides, herbicides etc);
- the store has the proper absorption materials (e.g. sand, sawdust etc), for the neutralization and the collection of pesticides, in case of leakages;
- the store does not cause any kind of pollution or inconvenience to neighboring houses or stores;
- volatile pesticides are not kept indoors, especially in closed rooms.

Which Certificates must be Submitted
The application for the license or for the renewal of a license for a Pesticides Store should be accompanied by the application fee of €34,17 (either by cash, cheque, or bank transfer).
On-site inspections are carried out in order to ensure that all the prerequisites, mentioned are met.

The applicant is informed regarding the authorization decision within 3 months from the date that the application form and supporting documents were duly submitted; given that the above mentioned criteria are fulfilled and no changes are recommended.
Licence Validity Period
The license for a Pesticides Store is valid for 20 years from the date of issue; the renewal fee is €34,17.

How to File an Administrative Action
Administrative Action Against a Competent Authority’s Decision
Any person may file an Administrative Action at the Administrative court against a decision, act or omission of any competent authority or body.
Pursuant to Article 146 of the Constitution, an Administrative Action may be lodged within 75 days from the date of the decision or act or omission or from the day when such decision or act or omission was notified to the applicant.
The Administrative Court acts as a cassation Court and not as a substantive Court. In other words, the Administrative Court may:
I. Dismiss the Administrative Action
II. Annul wholly or partially the contested decision or act
III. Compel the relevant authority or body to take a certain action
After a decision is annulled, the authority and/or public body must reverse things back to the state prior to when the concerned decision and/or act was executed and reexamine.
How to Appeal
An Appeal may be filed against the Administrative Court’s first-instance decision within a period of 42 days from the date such a decision was given.
At the Supreme Court (Court of Appeal Section) hearing, the contested issue of the appeal remains the legality of the decision or act already adjudicated. However, such a revision of the legality of the decision or act is solely examined on the matters and the extent that the two parties have limited the reasons in the relevant notice of appeal.
The decision adopted by the Supreme Court is considered final in relation to the matter that has been judged.

What are my Obligations
Licensed pesticides store operators are obliged to comply with the provisions of the Pest Control Products Law, as periodically amended, as well as with the terms and conditions of the licence. Indicatively licensed pesticides store operators are obliged to comply, among others, with the following:
- should not store or market food, beverages, pharmaceuticals, cosmetics, animal feed and liquid fuel at the same store or in a place that communicates with the store pesticides;
- can have in the same store selling pesticides fertilizers, agricultural machinery, tools and irrigation equipment, seedlings and seeds;
- are prohibited to manufacture, prepare or pack pesticides inside the store or alter in any way the packaging or label, or even have pesticides with broken packaging for sale;
- are prohibited to sell pesticides in people who do not have the ability to contract in accordance with the provisions of Articles 12 and of the Contract Law;
- make sure that the pesticides belonging in the first toxicity category, should be kept inaccessible from the buyer;
- only adult persons with good mental health according with the article 12 of the procurement law can carry and use first toxicity category pesticides.
